1. While dictating the order, I perused the affidavit of the attesting witness, namely Kailashchand Hukumchand Agarwal, affirmed on 27.11.2025. It appears that the deceased signed the Will in Hindi Varnacular. However, this witness does not state that conents of the Will were read over and explained to the deceased in her language, as per Rule 419 of the Bombay High Court (OS) Rules, 1980 read with Form No. 102 of the BHC Rules. 2.
The petitioner to file an affidavit of the attesting witness regarding the interpretation of the Will to the testator/testatrix, vide Rule 419 read with note provided at the foot of form No. 102 of the Bombay High Court (OS) Rules, 1980.
