TP/4220/2025 (E-filing) Mr. Sumit Raghani, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of Photocopy of last Will and Testament of deceased filed by petitioners namely Sailesh Hiralal Shah and Nayan Jayantilal Mehta being Executors named under the Will of deceased. The deceased namely Hansa Hiralal Shah died at Florida, USA on 27.06.2021. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 21.05.1999. The said Will is in Gujarati language and official translation of the said is not filed. The last line of the Will refers to the appointment of Executors. Only two Executors appointed under the Will who are petitioners herein. The properties mentioned in the Schedule are referred in the Will.

3. Ld. Advocate for petitioner submits that parents and husband of deceased predeceased the deceased. Deceased was survived by one son and three married daughters. Out of them son is petitioner No. 1 herein and all three married daughters have given their consents in favour of the petitioners herein. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Rashmikant Mohanlal Shah dated 31.01.2023 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 17.09.2025 is filed.
