All parties before us have agreed that without prejudice to the rights and contentions of the parties, the Hon'ble Mr.Justice S. J. Kathawalla (Retired), be appointed as a Mediator to try and see if the disputes between the parties can be amicably settled.

We would request the learned Mediator to hear the parties and explore the possibility of settlement. The learned advocates for the parties shall immediately forward a copy of this order to the learned Mediator, who shall then give all further directions as to how the mediation will proceed. The learned Mediator is requested to file his report in this Court within a period of six weeks from today. If for any reason, the learned Mediator requires any further extension, the parties are at liberty to apply to this Court. The costs of the Meditation shall be borne equally by the parties, namely, the Appellants and the Respondents in Appeal No.37 of 2024.

Place the above matters on Board "for directions" on 18th September, 2024.
