Mr. Jamshed Mistry, who is requested to appear as an amicus in this matter points out that the date of 24th April 2024 in paragraph 2 of our order dated 19th June 2024 should read as 24th April 2023.

Accordingly, we direct the above correction in our order dated 19th June 2024. Necessary corrections to be carried out in the original order and the corrected order to be uploaded on the website. 3rd July 2024

In any case, our order dated 19th June 2024 should be read along with this order.

The BMC has filed an affidavit along with photographs. From the affidavit filed, though, some of the footpaths appeared to have been cleared, we think that this is a recurring issue which requires constant monitoring. Learned counsel for BMC, on instructions, states that CCTV cameras can be installed at strategic places. Further, she states that presently a municipal vehicle has been stationed along with municipal officials to see that unauthorised hawking does not recur.

The BMC should also file an affidavit on the issue of CCTV cameras.

On the next occasion, we also consider whether some Court Commissioner should be appointed to pay surprise visit and report whether there is compliance with a direction issued by us in our order dated 24th April 2023.

We post this matter on 22nd July 2024 along with Suo Motu Writ Petition No.1 of 2023.
