When the matter is called out, Ms. Vijaya Ingule, learned counsel for the Defendants points out that there is an Interim Application under Order VII Rule 11 of the Code of Civil Procedure, 1908 ("CPC") seeking rejection of the plaint on the ground that mandatory pre-institution mediation has not been complied with prior to the filing of the suit. Mr. V. S. Kapse, learned counsel for the Plaintiff seeks some time to consider his position and to revert on the same.
