Mr. Subir Kumar, learned Counsel for the Appellant states that the present appeal involves tax effect of Rs. 1,53,65,312/- as set out in paragraph 11 of the memo of appeal. He submits that considering the tax effect in terms of Circular No. 5/2024, dated 15th March 2024 issued by CBDT, the proceedings are not needed to be taken forward and be permitted to be withdrawn. 2.

The appeal is accordingly allowed to be withdrawn. 3.

Refund of court fees as per rules.
