23. CHOL/30/2024 IN P.C. : The present Chamber Order is taken out by the Applicant for setting aside Order dated 30.06.2023, rejecting captioned Appeal under O.S.Rule 986 for non-compliance of office objections.

CUAPP(L)/18541/2022 ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) Affidavit of Service showing service of present Chamber Order is already e-filed. Despite service, none appeared for and on behalf of Respondent. Heard ld. Advocate for the Applicant. Perused Affidavit of the Applicant. It is contended therein that the present Appeal is filed on 10.06.2022 and office objections were complied on 13.07.2022, however, register remained to be signed after removal of office objections and the matter got rejected. It is further averred that due to change in Panel Advocate, delay of 55 days is caused in filing the Chamber Order. The Applicant requests for granting present Chamber Order by condoning delay of 55 days.

Considering grounds mentioned in the Affidavit of the Applicant, I am of the view that the Applicant has made out a case for restoration of captioned Petition. In view thereof, present Chamber Order is granted as prayed upon payment of cost of Rs. 2,500/- to 'The High Court Employees Medical Welfare Fund at Mumbai' - Bank of India Mumbai (Main) Branch, Account No. 000120110001337, IFSC Code : BKID0000001.
