CHOL/374/2024 in TPL/582/2020 ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) Mr. Moreshwar Hasbe i/b. Gauri Rao, Advocate for the applicant.

P.C.:

The present Chamber Order is e-filed by the applicant for setting aside Order dated 06.02.2023, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Heard ld. Advocate for the applicant. Perused Affidavit of the applicant. It is contended that all office objections were complied with, save and except, office objection with regard to Petitioner's Oath, which could not be complied with, within given period as it was executed at USA. It is further contended that at the relevant time, concerned Advocate had misinterpreted Order dated 06.02.2023 passed in the captioned Petition, however, now all office objections are complied with. Ld. Advocate submits that as on date, captioned Petition is uncontested.

Considering reasons mentioned in the Affidavit and submission of ld. Advocate for the applicant, the present Chamber Order is granted as prayed.

The petitioner to remove office objections, if any, on the Petition and get the same registered and/or numbered within two weeks from the date of uploading of order, failing Petition to stand rejected for non-compliance of office objections under O.S.Rule 986.
