By an order dated 18 December 2024 the respondents were directed to file their affidavit in reply on or before 15 January 2025 and the rejoinder within a period of two weeks thereafter. 2.

The learned counsel for the respondent nos.2 to 4 would tender the copies of the affidavit in replies on behalf of the respondent nos.2, 3 and 4 respectively. He would submit that the same have been served to the Advocate for the applicant. The learned counsel for the applicant would submit that they have filed such replies and the matter could be proceeded with. The learned counsel for the applicant also Pallavi Wargaonkar, PS 1/2

28-CARAP-211-2024 (OS) .doc placed on record an affidavit of service indicating steps taken to serve respondent no.1. Court notice was also issued to respondent no.1. however, service report is awaited.

The learned counsel for the respondent would submit that he would furnish a copy of the correct address to the counsel for the applicant, so that steps can be taken to serve the respondent no.1 by permissible mode of private service.

Let the same be completed on or before the adjourned date of hearing with an affidavit of service in that regard to be placed on record.

List the matter after two weeks i.e. on 11 March 2025. If the service to respondent no.1 is complete and the respondent no.1, despite service fails to appear, the matter shall proceed on the adjourned date of hearing and the Court would pass appropriate orders. 6.

Stand over to 11 March 2025.
