After the matter was heard for some time, Learned Counsel for the parties have graciously agreed that they have instructions from their respective clients to refer all their disputes and differences in the both captioned proceedings, to resolution by way of arbitration to be conducted by Mr. Cyrus Bharucha, a Learned Advocate of this court.

Taking on record the aforesaid submissions, all disputes and differences covered by the agreement containing the arbitration agreement namely the partnership deed dated JANUARY 22, 2025 Meera Jadhav

58-CARBP-265-23 .doc November 18, 1999, including all supplemental instruments amending the same, shall be referred to arbitration by the arbitral tribunal hereby appointed.

The Petition filed under Section 9 of the Arbitration and Conciliation Act 1996 ("the Act"), shall be treated as an application under Section 17 of the Act. Needless to say that given the efflux of time, should the parties desire to mould the submissions contained in their pleadings, they shall be at liberty to do so.

Both parties shall jointly appear before the Learned Sole Arbitrator appointed hereby, at a date and time convenient to him, no later than January 30, 2025. The Learned Sole Arbitrator shall issue further instructions on how to proceed further in the matter. With the aforesaid observations, both the proceedings are finally disposed of.

5.

All actions required to be taken pursuant to this order shall be taken upon receipt of a downloaded copy as available on this Court's website.
