Mr. Mody, the learned counsel appearing for Defendant Nos.1, 3 and 4 would submit that his clients are willing to settle the dispute with the Plaintiff-Bank. He has made a without prejudice offer on behalf of his clients of settling the disputes by paying amount of Rs.15 crores to the Plaintiff-Bank. He would submit that the offered amount of Rs.15 crores shall be paid to the Plaintiff-Bank within a period of 18 months. He would further submit that some upfront payment towards liability of Rs.15 crores would be made and that Defendant Nos.1, 3 and 4 are willing to bear the usual bank interest of Plaintiff-Bank on reducing balance basis till the entire amount of Rs.15 crores is paid. 2.
Mr. Singh, the learned Additional Solicitor General of India would submit that Plaintiff is a public sector bank and there is a Committee headed by a Retired Judge of this Court which alone can take a decision with regard to settlement of dispute. He would submit that the proposal of Defendant Nos.1, 3 and 4 together with copy of this order shall be placed before the Committee for appropriate decision. 3.
