At the outset, as the matter is settled between the parties, Leave Petition (L) No.9121 of 2023 is allowed. 2.

This Court is informed that the suit has been settled between the parties. The consent terms are tendered which are taken on record and marked "X" for identification. The consent terms have been signed by the constituted attorney of the Plaintiff and the partner of the Defendant-partnership firm and by their respective counsel. The Power of Attorney given by the Plaintiff is annexed to the consent terms and also the Aadhar Cards of the respective parties. The Plaintiff's representative is present through video conferencing however, the partner of the Defendant was unable to log in through sa_mandawgad 1 of

2 comip192-25 video conferencing. The identity of parties executing the consent terms have been verified by their respective counsel. 3.

The statement made in the consent terms are accepted as undertaking given to this Court.

The suit is decreed in terms of the consent terms. Refund of court fees as per Rules.

Decree be drawn accordingly.

The Court Receiver's Report is disposed of. The Court Receiver stands discharged without passing of accounts. The cost, charges and expenses of the Court Receiver to be paid by the Plaintiff within period of 7 days upon being called upon by the office of the Court Receiver.

Interim Applications, if any, do not survive for consideration and stands disposed of.
