Learned Counsel for the Applicant/Plaintiff has invited my attention to the order dated 2 nd September 2024 by which this Court had referred the Purti Parab

2/2 501-COMIP-376-2025 @ Ors.doc parties to mediation. Learned Counsel submits that the mediation has proved successfully and two sets of Consent Terms have been entered into. One between the Applicant/Plaintiff and Defendant Nos.1 to 4 and the other between the Applicant/Plaintiff and Defendant No.5. He has tendered copies of the Consent Terms entered into and submits that the suit be disposed of in terms of the said Consent Terms. Learned Counsel pointed out that the Consent Terms have been singed by the parties in the presence of the mediator and thus requests that the Consent Terms be taken on record and suit be disposed of in terms of the Consent Terms. Having regard to the submissions made the Consent Terms are taken on record and marked "X" and "X-1" for identification.

The suit is disposed of in terms of the Consent Terms. 3.

Interim Applications if any, are accordingly disposed of. 4.

Refund of Court fee, if any, as per rule.

In light of the aforesaid, the Leave Petition (L) No. 19921 of 2023 and Court Receiver Report No.339 of 2025 stands disposed of. The Court Receiver stands discharged without passing of accounts. 6.

All costs, charges and expenses of the Court Receiver are to be paid by the Plaintiff within a period of 8 days of demand being raised by the Officer of the Court Receiver.
