Ms. Anand, learned counsel for the Applicant/Plaintiff has today tendered the consent terms, by which he submits that the Applicant/Plaintiff and the Defendants in the suit have arrived at an amicable resolution of their disputes. She points out that the execution of the consent terms is duly supported by a report of the Associate of this Court, the same records as follows:
"The signatories have admitted the contents of the Consent Terms. The consent terms are duly signed by the parties out of their free will Vaibhav
2/2 3-IA(L)-21846-2023.doc without any undue influence and coercion. The consent terms are duly executed by the signatories."

Learned counsel also points out that the Defendant No.1 has been arrayed as Ajay Aggarwal and Seema Aggarwal. She submits that while Ajay Aggarwal was present before the Affirming Officer, Seema Aggarwal was not. Seema Aggarwal is present today virtually and has confirmed that she has read and understood the consent terms and has signed the same voluntarily and of her own free will. The Aadhaar Card of Seema Aggarwal is appended to the consent terms.

I am satisfied that these consent terms have been duly signed by Seema Aggarwal. The same are marked as "X" for identification and taken on record.

The suit is disposed of in terms of consent terms. 5.
The undertakings given in the consent terms are accepted as undertakings given to the Court.

In view of above, Court Receiver's Report No.350 of 2023 is also disposed of. There shall be a refund of Court fess, if any, as per rules. The Court Receiver, would stand discharged, subject to the payment of all necessary costs, charges and expenses of the Court Receiver, which shall be borne by the Applicant/Plaintiff.
7.
The Interlocutory Applications and the Leave Petition also stand disposed of.
