Today when the matter is called out, Mr. Anirudh Hariani, Gitalaxmi 2/3
learned Counsel appearing for Defendant No. 3 and for the Official Liquidator submits that two Interim Applications viz. Interim Application (Lodging) No. 22371 of 2023 and Interim Application (Lodging) No. 27872 of 2024 seek leave under Section 446 of the Companies Act, 1956, to implead the Official Liquidator and that the said two Interim Applications are also listed before the Company Court and therefore they be removed from board.

Mr. Aseem Naphade, learned Counsel for Defendant No. 15 submits that once these two Interim Applications before the Company Court are decided, this Court hear Notice of Motion No. 382 of 2017 as the pleadings are complete and there was also a direction to hear the said Notice of Motion expeditiously.

Having heard the learned Counsel, remove the aforesaid two Interim Applications from board and place them before the appropriate Bench taking up the company matters.
