After hearing learned counsel at some length, there is today no dispute regarding the fact that the defendant has acted in breach of the ex-parte adinterim order dated 18 th December 2023. A perusal of the affidavit in reply to Kiran Kawre

2/2 24-IA(L)-34887-2024 (OS).DOC the present interim application also makes this plain, Since, there is no denial to the contempt of the Applicant/Plaintiff but only some sort of explanation as to why the breach occurred. I am reserving my comments on the said explanation present.

Mr. Kamod learned counsel for the plaintiff has invited my attention to the previous order of this Court and pointed out that if the defendants are agreeable to (i) submit a solemn undertaking to this Court to not repeat the breach and (ii) make payment of costs, the entire suit would be resolved. 3.

Mr. Tyagi, learned counsel appearing (virtually) on behalf of the defendants submits that on instructions from the defendant, who he submits is present with him, the matter be stood over next week. He submits that the defendant shall offer payment of some costs.

Accepting the statement, stand over to 24 th September 2025 (HOB). List under the caption for settlement.
