Interim Application No.6172 of 2025 is an Application seeking condonation of delay in filing the written statement. The delay is within the 120 day period, this being a commercial suit. For the reasons set out in the Interim Application, the delay is condoned and the written statement is taken on record.

Learned Advocate for the Defendants submits that Defendant No.3 has passed away and she shall provide the details of the legal heirs to the Plaintiff within the next few days. The Plaintiff would then bring on record the legal heirs of Defendant No.3 and serve a copy of the proceedings on the newly added Defendants.

The proceedings in Sr. No. 80 on today's board would also require carrying out the same amendment to deal with bringing on record the legal heirs. Let such activity be completed before the next date.

Tag the captioned proceedings and list on January 6, 2026 under the caption "For Directions". Liberty to file a written statement, an unaffirmed copy of which is annexed to the Interim Application. Such filing will be done with the Registry within a period of one week from the date of upload of this order.

All actions required to be taken pursuant to this order shall be taken upon receipt of a downloaded copy as available on this Court's website.
