The petitioners have challenged the order dated 13.04.2023 passed by the Secretary, Urban Development, dismissing the appeal preferred by the petitioner challenging the order of demolition dated 03.03.2023.

2. Learned advocate for the petitioner submitted that the petitioner is in occupation of the residential premises since last more than 50 years which is a mundkarial house. The demolition is sought in respect to the extended portion which, according to the petitioners, he is entitled to occupy and purchase proceedings are pending. The inspection report relied upon by the authority for demolition of the property was done in the absence of the petitioners and the challenge to the said report was not considered by the authority.

3. Issue notice to the respondents, returnable on 17.10.2023.

4. In the meantime, there shall be ad-interim relief in terms of prayer clause (b) till the next date of hearing.
