The learned Counsel for the Petitioner relies on the decision of the Hon'ble Supreme Court in the case of Ram Lakhan and Ors. v/s. Presiding Officer and Ors.1 dated 17 November 1999 to contend that if the Standing Orders do not apply to the Petitioner, then there cannot be a restriction specified under the Standing Order as regard the percentage of the subsistence allowance and by default in such contingency 100% subsistence allowance should be paid. The Respondents will examine the aforesaid decision and if the contention of the Petitioner is found to be correct, will proceed to take necessary action. If the Respondents are of the opinion that the case is not covered by the law laid down in the aforesaid decision, then reply affidavit be filed dealing with the said decision.
