This Writ Petition challenges eviction order dated 25 August 2023 and the order dated 3 January 2024. It is the case of the Petitioner that his mother was the original tenant of the suit premises.

It is the case of the Petitioner that his mother was cheated by on the Respondent along with her associates. He further submits that criminal case in this regard is pending before Metropolitan Magistrate, Borivli. He further submits that 1/2

906-wp295-24.doc the subject premises is MHADA premises, therefore eviction application itself was not maintainable.

Issue notice to the Respondents, returnable on 7 February 2024. In addition to the Court notice, the Petitioner is permitted to serve the Respondents by private notice by all permissible modes of service and file affidavit of service before the next date.

In the meantime, there will be status-quo as of today till the next date of hearing.
