Issue notice to the Respondents, returnable on 21/02/2024. The learned A.G.P. waives service of notice on behalf of Respondent Nos.1 to 3. Mr Navandar, the learned Advocate waives service of notice on behalf of Respondent Nos.4 to 6.

The learned Advocate for the Petitioner makes a solemn statement on instructions that, the Petitioner is the only candidate from the 'PAP General' and 'PAP' of the same establishment category, and there are two vacant posts of the

432.24wp (2) 'Agricultural Assistant'. There is no other person available to be appointed.

In view of such categoric statement, we direct the Respondent/University to keep one post of the 'Agricultural Assistant' vacant.

The appointment of Respondent No.7, in the light of the judgment of this Court, dated 14/10/2022 in Writ Petition No.8479/2019 (Sachin Balasaheb Raner Vs. State of Maharashtra and others), shall be subject to the result of this Petition. 5.
