The Petitioners seek a direction that the college affiliated to the University of Mumbai, should pay them the regular salary as per the pay-scale, inclusive of all arrears. Since the college is affiliated to the University of Mumbai, such grievance of the Petitioners as against a private institution, can be entertained under section 79 of the Maharashtra Public Universities Act, 2016.

It is undisputed that though the Management has challenged Talwalkar

9.WP557.2025.odt the Judgment of the University and College Tribunal granting reinstatement in service to the Petitioners, steps have not been taken for seeking a hearing in the matter, in as much as, the Petitioners have been reinstated in service pursuant to the directions of the University Tribunal. 3.

The learned Advocate for the Management submits that, to some extent, this Petition suffers from suppression of facts. After the reinstatement, some of the Petitioners have voluntarily left the Institution. The learned Advocate for the Petitioners submits that this is not true.

In view of the above, this Petition is disposed off with liberty to the Petitioners to approach the Grievance Committee. All contentions are kept open. The Committee shall follow the due procedure laid down in law while dealing with the grievances of the Petitioners, expeditiously and without causing unnecessary delay and all contentions of the litigating parties are kept open to be considered.
