By this petition, the petitioner is taking an exception to the impugned judgment and order dated 26.12.2023 passed by respondent No.2/Scrutiny Committee by which the tribe claim of the petitioner of belonging to "Mannervarlu" Scheduled Tribe has been invalidated.

Learned counsel for the petitioner, inviting our attention to the genealogy at Page No. 70-B of the writ petition, submits that cousin sister of the petitioner namely Mansi, whose tribe claim was invalidated, had approached this Court by filing Writ Petition No. 144 of 2023 and this Court, by an order dated 10.08.2023 has considered the documents annexed with the

(2) 953 WP-588.2024.odt said writ petition and granted conditional validity. He would, therefore, urged that the petitioner deserves to be granted conditional validity.

Learned A.G.P. does not dispute the said aspect nor relationship of the petitioner with the said validity holder. In that view of the matter, we inclined to allow the writ petition and pass the following order

ORDER

(i) Writ Petition is partly allowed.

(ii) The impugned order dated 26.12.2023 passed by respondent No.2/Scrutiny Committee, is hereby quashed and set aside.

(iii) Respondent No.2/Scrutiny Committee is directed to issue validity certificate to the petitioner of belonging to "Mannervarlu"

Scheduled Tribe, which shall be subject to final decision to be taken by respondent No.2/Scrutiny Committee in reopened matters of the validity holders on which the petitioner is placing reliance.

(iv) Petitioner shall not claim any equity.

(iv) With these directions, writ petition stands disposed of.
