IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION WRIT PETITION NO.671 OF 2024 Smt. Gauri Nageshwara Rao Doddi
...Petitioner
V/s.
Suresh Vanraj Singh and Anr.
...Respondents
_______________ Mr. Shivshankar D. Patil for Petitioner.
Mr. A.K. Singh with Mr. Piyush Singh with Mr. Krishnakant Singh for Respondent No.1.
_______________ CORAM : SANDEEP V. MARNE, J.
DATED : 20 December 2024.
P.C.:
1) I have heard the learned counsel appearing for the parties.
2) It appears that an Agreement of Leave and License dated 10 July 2017 was executed between the Petitioner and Respondent No.1-Licensor granting license in respect of the suit Digitally signed by MEGHA SHREEDHAR PARAB Date:
2024.12.20 17:54:32 +0530 MEGHA SHREEDHAR PARAB premises for the period from 1 April 2017 to 31 March 2020. Admittedly, after 31 March 2020, there is no Agreement, by which the tenure of the license has been extended. License has Page No.

Megha 915_wp_671_2024.docx thus, come to an end on 31 March 2020. The Petitioner does not have a semblance of right to remain in occupation of the suit premises after 31 March 2020. The learned counsel for the Petitioner would strenuously rely upon another Leave and License Agreement dated 10 July 2017 executed in favour of Nageswara Rao Satyanarayana Doddi and claims that Licensee therein is Petitioner's husband. Perusal of the said Leave and License Agreement indicates that same is in respect of Shop No.11 and has nothing to do with Leave and License Agreement dated 10 July 2017 executed in favour of Petitioner in respect of Flat No.7.
3) The learned counsel appearing for the Petitioner would canvass the submission that there is matrimonial discord between the Petitioner and Respondent No.2 and that Respondent No.2 instigated Respondent No.1, who is his partner to evict the Petitioner from the suit premises. I am not impressed by the submission. Licensor has nothing to do with matrimonial dispute between the couple. Petitioner got entry into the suit premises through Leave and License Agreement dated 10 July 2017, tenure of which has expired. Therefore, Petitioner must vacate the suit premises. No error therefore, is traced in the order passed by the Competent Authority. Writ Petition is devoid of merits and it is accordingly dismissed. [SANDEEP V. MARNE, J.] Page No.
