This Court is getting new experiences daily. The primary rule of circulation is to intimate the other side. However, in many cases, the lawyer seeks circulation and pray for the order without intimating the other side.

In this case, the petitioner is also seeking an order against the order of the Collector for staying the election. However, the learned counsel for the petitioner did not intimate the contesting respondent, and he is praying for the order without intimating counsel for the contesting respondent.

There should be a fairness. No one should try to obtain the order without the knowledge of the other side. It is more than negligence. Hence, remove this matter from the board and list the matter on a fixed date.
