The petitioners who are the original land owners are seeking to derive benefit of Section 28A of the Land Acquisition Act, 1894 on the basis of the decision of the reference court, enhancing the compensation in respect of the other land owners for the same award, in Land Reference No.78/2002 and connected matters decided by the reference court on 27.02.2012.

Considering the fact that Section 28A provides a rider in respect of the period of limitation within which the applications are to be moved from the date the reference court passes an award, the petitioners having failed to submit the application within the stipulated time of three 1/2

45.WP.1045.25.odt months, their request simplicitor seeking a writ of mandamus directing the Land Acquisition Officer to consider the representation by issuing a writ of mandamus, cannot be entertained.

The writ petition is dismissed.
