The petitioners are challenging an order passed by the Special Recovery Officer in exercise of powers conferred under Rule 107, sub-rules 10 and 11, of the Maharashtra Cooperative Societies Rules, 1961. The petitioners have an appropriate remedy available to raise objections before the Special Recovery Officer under sub-rule 19 of Rule 107 of the Maharashtra Cooperative Societies Rules, 1961.

Hence, keeping all questions raised in the petition, open to be agitated before the Special Recovery Officer, the Writ Petition stands disposed of.

The learned Advocate for the petitioners states that the objection before the Special Recovery Officer remains undecided. The Special Recovery Officer shall decide upon the petitioners' objection in due course.
