The order impugned in the present writ petition rejects an application for condonation of delay filed in appeal under Section 96 of the Civil Procedure Code, 1908, which has a force of decree. Hence, remedy of the petitioner is to file second appeal against the impugned order.

Hence, by keeping all contentions raised in the present writ petition open to be agitated in second appeal, the writ petition stands disposed of.
