Paragraph No.7 of the Petition memo indicates the extent to which there are disputed issues with regard to the land, alleged forgery and fabrication of documents, signatures obtained of the original owner, Atul Haribhai Khandekar and sale of the land to another person, namely Kamlesh Motilal Yadav. Atul Haribhai Khandekar has sold some portion of the land to the Petitioner. 2.

Considering the above disputed issues, we would not entertain this Petition.

The learned Advocate for the Petitioner submits, on instructions, that the Petitioner would avail of a remedy of filing a Civil Suit for declaration of ownership over the land and her share of the land purchased from Atul Haribhai Khandekar, identify the encroachment, seek a declaration that the encroachment is illegal, seek demolition of the encroachment and a further order for restoration of the possession of the Petitioner. 4.

In view of the above statement, this Writ Petition is disposed off as withdrawn. If the Petitioner approaches the Civil Court, all contentions are kept open and the withdrawal of this Petition would not be an impediment.
