DATE : 20th JUNE, 2025 P.C. :- 1) After the matter was argued for some time, the matter was kept back for both the learned counsel to take instructions from their clients.

2) Later on the matter was called back again, when both the learned counsel on instructions jointly pleaded that the petitioners are not pressing the petition any further and would be satisfied if the hearing of the suit pending before the Trial Court is expedited. 3) Hence, the following order :- i) By consent, writ petition is disposed of as not pressed.

KVM 2/2 12 - WP 1514 OF 2024.doc ii) The hearing of the RAE Suit No. 1349 of 2022 pending before the Court of Small Causes at Bombay is expedited.

iii) Both the parties through their learned counsel submits that they will co-operate with the hearing of the said suit and will not seek unnecessary adjournment.

iv) Since this Court has not decided the petition on merits, therefore the Small Causes Court to decide the suit on its merit and without being influenced by any observations made by this Court.
