According to the petitioner, petitioner appointed respondent No.4 for carrying out work of construction. Prima facie, it appears that the Labour Judge has not taken into consideration tests laid down by the Supreme Court in the case of Workmen of Nilgiri Co-operative Marketing Society Ltd. Vs. State of Tamil Nadu reported in 2004 (3) SCC 514.

Hence, till next date, there shall be ad-interim relief in terms of prayer clause (c) qua petitioner only.
