The learned counsel appearing for the Petitioner, on instructions, seeks leave to withdraw the Petition with liberty to file Appeal against the impugned order. She would submit that the time spent in prosecuting the present Petition be considered while computing the delay in filing the Appeal. It would be for the Petitioner to file appropriate application for condonation of delay in filing the Appeal by citing the reason of pendency of the present Petition. The Writ Petition is accordingly allowed to be withdrawn and disposed of with liberty to prefer Appeal against the impugned order.
