The Petitioner is challenging the Order dated 07.10.2024 passed by the learned Judge, Family Court No. 2, Pune passed in Petition No. A-1064 of 2023.

Learned Advocate for the Petitioner submits that the Application was filed by the Respondent under Section 24 of the Hindu Marriage Act, 1955 for granting interim maintenance. According to him, such Application was not maintainable, since the Petitioner has filed the Petition for divorce under Section 12(1)(c) of the Hindu Marriage Act, 1955. The Respondent was already married and during the subsistence of the first marriage, she performed the second marriage. It is submitted that since he has prayed for decree of nullity, the Application for interim maintenance filed under Section 24 of the Hindu Marriage Anand
