Learned Counsel for respondents placed on record photo copy of order dated 01/03/2024, passed in Regular Civil Suit No.735/2020 intimating that the suit is dismissed in default. Thus, it is his submission that the petition filed challenging order passed below Exhibit 5 and order passed by the learned District Court in Misc. Civil Appeal No.31/2022 has become infructuous.

Learned Counsel for petitioner submits that the plaintiff wishes to take appropriate steps for restoration of the suit at the earliest, he therefore, requests for postponement of the hearing of this petition. According to him dismissal of the petition will not be in the interest of both sides as if the suit is restored, fresh petition will have to be filed.
