We have heard Mr. Jha, learned counsel for the petitioner and Mr. Bamne, learned counsel for Respondent No.3 for sometime. Before we delve on the merits of the rival contentions, we accept the request as made on behalf of the Respondent No.3 to adjourn the proceedings to 3rd September, 2024 to enable Respondent No.3 to consider as to whether the dispute in the present proceedings can be resolved by accepting the petitioner's request to refund the amounts in view of the developments, which 30 August, 2024 Aarti Palkar
913.WP.2045.2024.doc have taken place after conducting of the e-auction of the secured asset. In this regard, the significant aspect being that the original allotment of the land which was made in favour of the Arunachal Pradesh Industrial and Financial Development Corporation Limited on whose title the bank was persuaded to accept the property in question as collateral security in grant of a loan to US Roofs Ltd. and US Infra Housing Pvt. Ltd., itself was cancelled, rendering the security to be left without title.
