DATE : 7 MARCH, 2024 P.C. :- This writ petition is filed by the wife thereby challenging the order dated 28 July, 2023 passed by the Family Court, Mumbai, on the issue only of quantum.

It is the case of the petitioner that she had claimed maintenance at the rate of Rs.30,000/- per month from the husband who is government servant, working with P.W.D. Department, as an architect and his monthly salary is around Rs.1,00,000/-.

She had also claimed that the petitioner is an home maker and her child is a 'special child'. However, the Court has granted maintenance only to the tune of Rs.7,500/- to the wife and the son.

Mr.Gawade further submits that even the amount which is allowed by the Family Court, has not been paid by the husband. 5.

Issue notice to the respondent returnable on 21 March, 2024, Humdast is permitted. Apart from the Court notice, the petitioner is permitted to serve the respondent by private notice, by all permissible modes of service and file affidavit of service before the next date of the hearing.

Stand over to 21 March, 2024, High on Board.
