The petitioner takes exception to the order dated 12.02.2024 passed by Respondent No.2-Scrutiny Committee by which the tribe claim of the petitioner of belonging to 'Koli Mahadev', Scheduled Tribe has been invalidated.

Learned Counsel for the petitioner submits that the cousin brother of the petitioner namely, Rutwik Dilip Raut whose tribe claim was invalidated had approached this Court by way of Writ Petition No.8681 of 2019 and this Court after considering the selfsame record has granted conditional validity to him by an order dated 17.07.2019. 4.

Learned Counsel for the petitioner therefore submits that the petitioner deserves to be granted conditional validity. Narwade

Learned AGP does not dispute the fact of grant of conditional validity to said Rutwik Dilip Raut so also does not dispute the relationship of the petitioner with the said validity holder. 6.

In view of the same, we find that the petitioner deserves to be granted conditional validity. In that view of the matter, we pass the following order :- :: O R D E R ::

i.

The impugned order dated 12.02.2024 passed by Respondent No.2-Scrutiny Committee is set aside. ii.

Respondent No.2-Scrutiny Committee shall issue validity certificate to the petitioner of 'Koli Mahadev', Scheduled Tribe immediately. The same shall be subject to the decision that would be taken by Respondent No.2-Scrutiny Committee in case of reopening of the proceeding granting validity to the real brother, real sister and real uncle's son of the said validity holder, Rutwik Dilip Raut.

iii.

Writ Petition stands disposed of.
