IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 931 WRIT PETITION NO. 2542 OF 2024 KUNWARPREETSINGH S/O JOGINDERSINGH

VERSUS

DARSHANKAUR W/O S. KUNWARPREETSINGH C/O SARJEETSINGH GILL ...

Advocate for the Petitioner : Mr. Deshmukh Swapnil A. ...

CORAM : RAVINDRA V. GHUGE & R.M. JOSHI, JJ.

DATE :

7th March, 2024 P.C. :- 1.

It is well settled that a Judicial Officer or a Court should not be issued with a Writ of Mandamus to decide a particular proceeding within a particular time line.

2.

We are aware of the pendency of the proceedings before the Family Court, Nanded. Divorce Petition No.23/2021 along with Petition No.228/2018, are not so old that this Court could direct the Family Court to decide the same out of turn.

3.

In view of the above, this Writ Petition is disposed off. Let the Family Court at Nanded deal with the said two cases, in queue, considering the date of the lodging of the proceedings. For convenience, both the cases may be decided together, if the parties agree.
