After this petition was heard for sometime, Mr. Vaidya, learned counsel for the petitioner, and fairly so, considering the order dated 04 July 2011 passed by the learned Single Judge of this Court in Writ Petition No. 3142 of 2011, seeks leave to withdraw this petition with liberty to move appropriate proceedings before the learned Charity Commissioner, as also to seek urgent ad-interim reliefs. This more particularly considering the specific directions recorded in paragraph 5 of the said order. We accordingly permit the petitioner to withdraw the petition with liberty as prayed for.

In the event the petitioner moves an application within a period of one week, the learned Charity Commissioner shall consider the prayers for ad-interim reliefs and pass appropriate orders. 3.

All contentions of the parties are expressly kept open. 4.

Disposed of. No costs.
