It appears that as against the letter / order dated 18th November 2008 issued by the Prinicipal, Vaidyanath Collector, Parli Vaijanath, District Beed, one Bapurao Waghmare instituted an appeal bearing BAMU 12 of 2008 before the learned Presiding Officer, College Tribunal, Aurangabad. In the course of time, the appeal was abated. Consequently, two applications bearing Exhibit-A-73 for condonation of delay and setting aside the abatement, as also the application bearing Exhibit-A-21 for incorporating the names of the applicants on record as legal representatives of the appeal was filed. After hearing both the parties, vide order dated 08th January 2024, the learned Presiding Officer of the College Tribunal allowed both the applications. Shrikant Malani

918.WP.2709.2024.doc The delay of 10 years was condoned, the abatement was set aside, and the applications there were allowed to prosecute the appeal to the limited extend as the legal representatives of the deceased Bapurao Waghmare. As against this order, the petitioner management is before this Court.

Notice were issued by this Court. On 12th March 2024, this Court passed an interim order permitting learned Tribunal to hear the final arguments in the appeal but to hold the judgment until further orders.

Today, in both sessions ,nobody appeared for the parties. 4.
