I have heard Ms. Cheema and Mr. Amanchi, learned Advocates appearing for the respective parties. 2.

After hearing the facts in the present case for some time, I have impressed upon both the learned Advocates to take appropriate instructions from their clients to refer all their disputes either to mediation or arbitration. This is specially in view of the fact that the Writ Petitioner has also filed a parallel companion suit in Mumbai against the Respondent seeking substantive damages and other claim which is pending.

In so far as the present suit proceedings before the learned Trial Court in Thane is concerned, the same is instituted by the Respondent seeking recovery of amounts under certain invoices.

Be that as it may, in that view of the matter, parties are requested by this Court to consider referring all their disputes to either mediation, arbitration or even consider an amicable resolution, if it is possible between the parties.

Both the parties before me are Companies operating in the real estate world in Mumbai and in that view of the matter, the aforesaid order is passed strictly without prejudice to their rights and contentions, if so considered.

In the meanwhile, ad-interim relief granted earlier, if any, to continue.

Stand over to 04th April, 2024 at 02.30 p.m.
