Learned counsel for the petitioner on instructions seeks leave to withdraw the petition with liberty to file an appropriate application before the Family Court for restoration of her application for interim maintenance.

Since, the interim application for maintenance is dismissed on the ground that the petitioner was absent and she had not filed any affidavit of assets and liabilities, I am inclined to grant leave with liberty as prayed. Leave granted with liberty as prayed. 3.

Writ Petition is disposed of as withdrawn, with liberty as prayed.

If any appropriate application is filed before the Family Court the concerned learned Judge of the Family Court shall decide the application on its own merits uninfluenced by the impugned order. 5.
