The Petitioner is awaiting a Validity Certificate. She claims to be belonging to the Rajput Bhamta Scheduled Tribe Category. She is in employment and is under a threat of termination since the proposal for seeking Validity Certificate is pending since 30th October, 2017. She is willing to tender an Affidavit Undertaking not to claim any service benefits until her claim is decided and seeks protection.

The learned AGP submits that the claim of the Petitioner would be decided by 31st October, 2025.

In view of the above statements, this Petition is disposed off with the following directions:
(a) The Petitioner shall tender an Affidavit Undertaking declaring that she would not seek increments/pay revisions/promotions/service benefits, etc. until her claim is validated, either by the Committee or by the Court. (b) Let such Affidavit Undertaking be filed in this Court and with a copy to Respondent No.4, within a period of 21 days from today.
(c) On submission of such Affidavit Undertaking, the Employer shall not terminate the service of the Petitioner only for the reason that she does not have a Validity Certificate.

(g) The Committee would deliver its verdict on or before 31st October, 2025.
