By the impugned order, the Assistant Registrar has granted approval to the appointment of Secretary. The question involved is under which provision the society is required to seek approval of Assistant Registrar while appointing the Secretary. Such power needs to exist either in act, rule or bye-rule. Therefore, respondent No.2 shall file affidavit indicating source of power for grant of approval while appointing Secretary in Cooperative Milk Society. 2.

The affidavit to be filed within two weeks from today. 3.
