The co-owner of the suit premises filed an application in the suit challenged notice under Section 53 of the Maharashtra Regional Town Planning Act, 1966, which has been allowed by the impugned order.

In view of the of Division Bench of this Court in the case of Ashok Babu Lal Awasthi Vs. Munna Nizamuddin Khan & Anr., reported in 2023 SCC OnLine Bom. 2559; hence, the Trial Court has rightly exercised its discretion. Therefore, no interference is called for.
