Upon arguing the matter at length Mr. C. V. Dharurkar, learned Counsel for the petitioner on instructions seeks leave to withdraw the petition. He further submits that since the suit is still pending before the competent Civil Court, the petitioner may be at liberty to have the case heard on merits. 2.

In view of above, Writ Petition stands disposed of. Needless to mention the Civil Court is a competent Court to crystallize the civil rights of the parties and the findings of the Civil Court shall be binding on all the parties.
