Learned Counsel Mr. Suryawanshi has appeared for respondent Nos. 4.

A simple question is, whether the Chief Officer can change the assessment of tax standing in the name of the petitioner when the dispute for allotment of plot is pending before the competent court of law.

The Chief Officer/Respondent No. 3 had rejected the application of respondent No. 4, observing that the suit about the suit plot is pending before the Co-Operative Court. Hence, after the decision of the said Court, an appropriate action will be taken. On these observations, he dismissed the application. However, by impugned order, the Additional Divisional Commissioner, Aurangabad, allowed her Revision and against the said order, the petitioner is before this Court. 6.

There shall be an interim stay to the impugned judgment and order till the next date.
