According to the petitioner, the 5 Grampanchayat members out of 11 members were deemed to be disqualified for failure to submit their caste validity certificate within the period prescribed under Section 10 (1A) of the Maharashtra Village Panchayats Act, 1959. According to the petitioner, on failure to furnish such cast validity certificate disqualification is automatic and, therefore, the 5 members would not be the persons entitled to vote in no confidence meeting. In support of his submission, he placed reliance on the certificate issued by the Public Information Officer, Naib-Tehsildar dated 27 June 2023 indicating that the 5 members were present in the meeting and they had not furnished their cast validity certificate.
