CORAM
: AMIT BORKAR, J.
DATED : APRIL 10, 2024 P.C.:
1.
On prima facie perusal of the proceedings under Section 88 of the Maharashtra Co-operative Societies Act, 1960 ("the Act"), it appears that neither a report under Section 81, 81(5)(b) nor Section 83 of the Act was placed before the Assistant Registrar. 2.
Prima facie, it appears that the record of Society has burned. It is, therefore, not clear from the impugned orders, the basis of recording finding against the petitioner which has drastic consequence of disqualification in life.
3.
Hence, issue notice to respondents, returnable on 24th April 2024.
38-wp-3532-2024.doc 4.
The Authorities shall file affidavit indicating the material available with them for arriving at conclusion under Section 88 of the Act.
5.
Affidavit to be filed within two weeks from today. 6.
Till 24th April 2024, no coercive steps shall be taken against the petitioner.
