The predominant prayer in this writ petition is directed against the order dated 07.02.2024, passed below Exhibit U-2 by the learned Member of the Industrial Court, Aurangabad, in Complaint ULP No. 98 of 2023. This was an application seeking interim relief under Section 30(2) of the Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices Act, 1971, specifically for :

• Staying the chargesheet dated 23.08.2023;

• Directing further enquiry till the pendency of the complaint, or • Directing the respondent to conduct an enquiry in the factory of the company and supply CCTV footage free of cost. 2.

The petitioner has also challenged the notice dated 20.10.2023 and order dated 08.11.2023 passed by the Enquiry Officer. This matter was filed in March 2024 and notice was issued on 26.04.2024. Mr. Marlapalle,

( 2 ) 950 WP 3737 OF 2024 learned counsel has marked his appearance for the respondent - establishment.

Today, when the matter was called out, none appeared for the petitioner. Mr. V. D. Kulkarni instructed by Mr. Y. R. Marlapalle, learned counsel for the respondent is present. However, he would submit that the enquiry against the petitioner has since been completed and the petitioner has been terminated by the respondent - management. He would further submit that the petitioner has even challenged that termination before the learned Labour Court, Aurangabad.

In view of these subsequent developments, it is apparent that no substantive relief remains to be granted in this writ petition. It is needless to mention that the petitioner retains the right to agitate all contentions and objections raised in this petition in Reference No. 13 of 2025 pending before the learned Labour Court, Aurangabad.
